2009 Rules and Regulations
1. APPLICATION One hundred (100) percent of entry costs must accompany application. All admissions must be received on or before 5:00 p.m., August 7, 2009. Entries received after August 7 will incur a $30.00 late fee. All entries are subject to space availability.
2. CONTESTANT CANCELLATION The cancellation of Contest Space by the Contestant must be in writing, not by telephone, and received by the American Royal Barbecue (Hereafter “the Royal”) at least 30 days prior to the first day of the contest. In such event, the Royal shall refund the Rental Fee paid by the Contestant less the Non-Refundable Deposit. The Non-Refundable deposit will a 25% fee based upon the cost of the Contestants space. A refund minus the Non-Refundable Deposit will be granted if, and only if, the Royal rents the Contest Space to another Contestant for the sum equivalent to or greater than the Rental Fee. Occupancy of the Contest Space is the essence of this Agreement. If the Contestant does not occupy the Contest Space by 10:00 am Saturday, and has not given the Royal the required written notice of cancellation, the Royal shall have the right to use the Contest Space in such manner as it may deem in the contest’s best interest. Should the Royal rent the Contest Space to another Contestant, it shall make a prorated refund to the Contestant of the rental proceeds, the rental fees less the Non-Refundable Deposit paid by the Contestant.
3. FORCE MAJEURE In case of cancellation of the contest or unavailability of the Contest Space for the specified due to war, governmental action or order, act of God, fire, strike, labor disputes, or any other cause beyond the Royal’s control, this Agreement shall terminate, and the Contestant shall be entitled to the return of the Rental Fee for the Contest Space, less the prorated share allocable to the Contest Space of the expenses incurred by the Royal in connection with the contest. In case of cancellation by the Royal for any other reason, or a change in the place or date of the contest which is unsatisfactory to the Contestant, the Contestant shall be entitled to return of sums paid for the Contest Space. Refund of the Rental Fees as provided in this section shall be the exclusive remedy of the Contestant against the Royal in case the contest is cancelled or rescheduled or the Contest Space is unavailable to use in case of damage to the contestant space through war, governmental action or order, acts of God, fire, strike, labor disputes, or any other cause beyond the Royal of and from all claims for damage and agrees that the Royal shall have no obligation except the above stated refund.
4. SUCCESSORS INTEREST This Agreement shall bind the respective parties and their successors in interest.
6. RULES AND REGULATIONS If a Contestant does not follow the Rules and Regulations set by the Royal and then this contract may be terminated. In the event of a default by the Contestant, the Contestant shall forfeit as liquidated damages the amount paid by him in connection with his application, regardless of whether or not the Royal enters into a further lease of the Contest Space involved.
7. SPACE ASSIGNMENTS Contest Space assignments will be made by the Royal in keeping with the preferences as to location requested by the Contestant. The Royal reserves the right to make the final determination of all Contest Space assignments in the best interest of the contest. Space assignments on the map provided may vary according to size depending upon permanent obstacles and emergency requirements within the American Royal Complex. The Royal reserves the right to adjust this space to meet any of these needs.
9. ASSIGNMENT, SUBLETTING OF CONTEST SPACE No Contestant shall assign, sublet or share the Contest Space allotted without the knowledge and consent of the Royal. No firm or organization not assigned Contest Space will be permitted to solicit business within the contest areas. No merchandise can be distributed or sold without the authority and permission of the Royal. Violation of this may result in forfeiture of merchandise and eviction from the event.
10. USE OF SPACE This Agreement allows the Contestant to occupy Contest Space on October 1 – 4, 2009. The Royal reserves the right to restrict contestant spaces which, because of the noise, method of operation, materials, or for any contestant space which, in the opinion of the American Royal, may detract from the general character of the contest as a whole. All demonstrations or promotional activities must be confined within the limits of the Contest Space. Demonstrations or activities that cause annoyance to neighboring contestants such as flashing lights or noise or result in obstruction of walk space or prevent ready access to a nearby Contest Space will not be allowed. There will be QUIET TIME on Saturday from 1:00 a.m. to 7:00 a.m. in Lots A, C, D and the North Lot. A QUIET TIME of midnight until 7:00 a.m. will be enforced in Lot B. Use of stereos, live music or amplifying equipment will not be allowed during this QUIET TIME period. Each barbecue team is responsible to see that QUIET TIME is enforced. All teams are responsible for enforcing the rules and regulations of the contest. Non-permitted activities include damage to fences, moving of fences, changing of boundary markers, unauthorized entry onto the grounds, operating a vehicle by a team member or team guest on the grounds during an unauthorized time, parking of a vehicle by a team member or team guest on the grounds in an unauthorized area. All Seasons Party and Tent Rental is the official supplier to the Royal and the only commercial tent company allowed on the grounds. Contestants may bring and set up personal tents without the aid of a different commercial tent company. Johnny on the Spot is the official supplier to the Royal and the only private toilet company allowed on the grounds. Violation of these rules is grounds for disqualification and could result in disqualification in future contests. Interpretation of these rules are the responsibility of the Royal and are not appealable. The Royal reserves the right to prohibit the display of any article that, in its opinion, is not in keeping with the nature and character of the contest, or the American Royal Association.
11. ORDINANCES The Agreement shall in all respect be governed by the laws of the state of Missouri and the municipal ordinances of the City of Kansas City, Missouri. To ensure the safety of all participants, fire regulations, health and other applicable ordinances of Kansas City, Missouri must be followed.
12. AUTHORIZED AGENTS All Contestants/Teams will have an appointed agent or Chief Cook with full authority to represent the Contestant/Team in its business with the Royal.
13. FAILURE TO SUBMIT Teams not submitting at least one meat entry to Open Contest Judging will be denied participation in the American Royal Barbecue Contest the following year at the discretion of the American Royal.
14. LIABILITY AND INSURANCE Neither the Royal or Kansas City, Missouri, nor the representatives, will be responsible for any injury, loss or damage that may occur to the Contestant or the Contestant’s employees or property from any cause whatsoever. It is the Contestant’s responsibility to protect machinery and contestant space so that no injury will result to the public, visitors, guests, or persons or property. All property of the Contestant is understood to remain in the Contestant’s care, custody and control in transit to, from, or within the confines of the contest Area subject to the Rules and Regulations. The Contestant, upon signing the Agreement, expressly releases, holds, keeps and saves harmless and indemnifies the forgoing names, organizations and committees and individuals from all claims for such loss, damage, or injury. Contestants are advised to carry insurance to cover any of the above.
15. SECURITY The Royal will provide security on the contest grounds during the hours the contest is open and closed. Any additional security must be provided by the Contestant. The Royal does not in any way insure the safety of said contestant space and disclaims any and all liability for damage to contestant spaces or contestants through any means not within its control.
16. ACCEPTANCE All applications are subject to review and acceptance by the Royal. Decisions made by the Royal are final and not appealable.
17. MEAT CATEGORIES Competition will be held in the following categories for the Grand Championship:
1. Chicken, 2. Pork Ribs, 3. Beef Brisket, 4. Pork (pork shoulder or Boston Butt). The following category is optional and will not count toward the Grand Championship scores: Sausage. A Contestant may enter any number of categories of meat by designating those categories on the application. Only one entry per team per category is allowed. In order to be eligible for the award of overall Grand Champion of the American Royal Barbecue, a contestant must enter all categories except sausage.
18. ALCOHOLIC BEVERAGES Excessive use of alcoholic beverages may be grounds for disqualification. Under no circumstances shall alcoholic beverages be distributed to the general public by Contestants.
19. CHANGES AND AMENDMENTS The Royal reserves the right to make changes to these rules. Any matters not specifically covered herein are subject to decision by the Royal. The Royal reserves the right to make such changes, amendments and additions to these rules as considered advisable for the proper conduct of the contest with the provision that all Contestants will be advised of any such changes in writing. |
